4. Service Description

Wheels4Cash offers a streamlined and efficient service for individuals looking to sell their vehicles. Our services include the following:

• Vehicle Valuation:
  • Initial Assessment: Customers can provide basic details about their vehicle through our online form or by contacting our customer service team. This includes information such as make, model, year, mileage, and condition.
  • In-Person Inspection: A thorough inspection is conducted by our professional evaluators at a designated location. This inspection covers both the exterior and interior condition, mechanical aspects, and any additional features of the vehicle.
• Offer Communication:
  • Instant Online Offers: Based on the initial assessment, customers receive an online offer. This offer is subject to change following the in-person inspection.
  • Final Offer: After the in-person inspection, a final offer is communicated to the customer. This offer is valid for a specified period, typically 3 consecutive days, allowing the customer time to consider the proposal.
• Assisted Car Sales:
  • Best Quotes: We assist customers in obtaining the best quotes for their vehicles within our approved dealer network. This ensures that customers receive competitive offers from trusted buyers within Wheels4Cash Dealer Network.
  • Dealer Network: Our network consists of reputable dealers who have been vetted and approved by Wheels4Cash, ensuring a reliable and secure transaction process.

 

5. Fee Structure and Payment

• No Hidden Fees: Sellers will not be charged any fees for facilitating their transactions, unless otherwise stated upfront on the transaction.
• Service Fee: Buyers or Buying Dealers will be charged a service fee, which covers vehicle inspection and any other administrative costs incurred.
• Payment Processing: Payments are processed promptly once the offer is accepted, with options including bank transfer or cheque.

 

6. No Warranties

We give no warranties, conditions, guarantees, or representations, expressed or implied, as to:

• The completeness or accuracy of information or any advice that may be contained on the website or any website to which it is linked.
• The content of the advertisements for information appearing on the website, including but not limited to, the ownership, quality, authenticity of any photographs, compliance with description, or fitness for purpose of any vehicles.

 

7. No Obligation Unless in Writing

We will not be bound to any allegations that a contract or legally binding arrangement has been entered into between you and Wheels4Cash unless such contract or arrangement has been confirmed by Wheels4Cash in writing.

 

8. Selling Your Vehicle

By submitting your vehicle details to Wheels4Cash, you agree to provide accurate and complete information. Wheels4Cash reserves the right to verify the information provided and to refuse any submission that is found to be inaccurate or incomplete. The offer provided by Wheels4Cash for your vehicle is subject to a physical inspection and may be adjusted based on the condition of the vehicle.

 

9. Purchase Policy

• Vehicle Selection: Wheels4Cash reserves the right to choose which vehicles it wishes to purchase.
• Offer Criteria: Offers are made based on the criteria specified on the Wheels4Cash website.
• Transaction Discretion: Wheels4Cash may decline to proceed with a vehicle purchase at any stage, at its discretion.

 

10. Inspection and Evaluation

Upon submission of your vehicle details, Wheels4Cash will arrange for an inspection and evaluation of your vehicle. This process includes:

• A thorough physical inspection of the vehicle will be done by a representative of Wheels4Cash.
• An evaluation of the vehicle’s condition, including but not limited to, its mechanical state, bodywork, interior, and any modifications.
• Verification of the vehicle’s documentation, including ownership and service history.
• Based on the inspection and evaluation, Wheels4Cash will provide a final offer for the vehicle. This offer may differ from the initial estimate provided online.
• Vetting Process: It may arise that we are unable to confirm an offer based on the vetting process, which is beyond our control. In such cases, we will notify the affected parties promptly.

 

11. Non-Compliance with Agreed Conditions

 If the vehicle does not meet the agreed-upon conditions during the inspection and evaluation process, Wheels4Cash reserves the right to:

• Reject the Offer: Decline the transaction if the vehicle’s condition significantly deviates from the agreed terms.
• Adjust the Offer: Propose a revised offer that reflects the actual condition of the vehicle.
• Request Additional Information: Ask for further details or documentation to reassess the vehicle’s condition.
• Cancel the Transaction: Cancel the transaction if the discrepancies cannot be resolved satisfactorily.

 

12. Offer and Acceptance

• Offer Validity: The offer from Wheels4Cash is valid for a specific time, as mentioned in the service description.
• Acceptance: To accept, you must confirm in writing within this time.
• Lapse of Offer: If you don’t accept within this time, the offer expires, and Wheels4Cash is not obligated to honor it.
• Agreement: Once accepted, a legally binding agreement is formed based on the offer and these Terms.

 

13. Payment Terms

• Payment Method: Payment via electronic funds transfer (EFT) to the seller’s provided bank account.
• Seller’s Responsibility: Provide accurate and complete bank account details.
• Liability: Wheels4Cash is not liable for delays or errors due to incorrect or incomplete bank account information.
• Payment Timeline: Payment will be made within 72 hours after the Final Offer is accepted

 

14. Conditions for Non-Payment

• Incorrect Bank Details: If incorrect or incomplete bank account information is provided.
• Fraudulent Activity: If there is suspicion or evidence of fraud.
• Disputed Ownership: If there are disputes regarding vehicle ownership.
• Pending Documentation: If required documentation (e.g., proof of ownership, identification) is not provided or is incomplete.
• Contractual Breach: If the seller breaches any terms of the agreement.
• Inactive Bank Account: If the seller’s bank account is inactive or unable to receive EFT payments.

 

15. Seller Obligations for Vehicle Sales

• Ownership and Title: The seller must provide proof of ownership and a clear title for any vehicle sold to or facilitated by Wheels4Cash. The vehicle must be free of any encumbrances.
• Accurate Information: The seller is required to provide accurate and complete information about the vehicle, including but not limited to its make, model, year, mileage, and condition. Any known defects or issues must be disclosed.
• Vehicle Inspection: The seller agrees to allow Wheels4Cash or its designated representatives to inspect the vehicle prior to finalizing the sale. The inspection may include a physical examination and a test drive.
• Documentation: The seller must provide all necessary documentation related to the vehicle, including the registration, service records, and any other relevant paperwork.
• Warranty and Guarantees: The seller warrants that the vehicle is in the condition described and that there are no undisclosed issues that could affect its value or operation. The seller guarantees that all information provided is truthful and accurate.
• Transfer of Ownership: Upon completion of the sale, the seller agrees to promptly transfer ownership of the vehicle to Wheels4Cash, including signing over the title and any other required documents.
• Compliance with Laws: The seller must comply with all applicable laws and regulations related to the sale of the vehicle, including but not limited to emissions standards and safety requirements.
• Indemnification: The seller agrees to indemnify and hold Wheels4Cash harmless from any claims, damages, or liabilities arising from the sale of the vehicle, including any false or misleading information provided by the seller.
• Post-Sale Assistance: The seller agrees to assist and resolve any matters that arise after the sale, including but not limited to providing additional documentation, addressing any undisclosed issues, and cooperating with Wheels4Cash to ensure a smooth transition of ownership.

 

16. Privacy Policy

• Wheels4Cash is committed to protecting your privacy. Please refer to our Privacy Policy for information on how we collect, use, and disclose your personal information.

 

17. Dispute Resolution

Any disputes arising out of or in connection with these Terms shall be resolved through   the following process:

• Negotiation: The parties shall first attempt to resolve the dispute informally through good faith negotiations.
• Mediation: If the dispute cannot be resolved through negotiation, the parties agree to submit the dispute to mediation, with a mediator agreed upon by both parties.
• Arbitration: If the dispute cannot be resolved through mediation, it shall be referred to and finally resolved by arbitration in accordance with the rules of the Arbitration Foundation of Southern Africa (AFSA). The arbitration shall be conducted in Johannesburg, South Africa, and the language of the arbitration shall be English. The decision of the arbitrator shall be final and binding on the parties.
• Governing Law

These Terms are governed by and construed in accordance with the laws of South Africa. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa.

• Choice of Law

These Terms and any disputes arising out of or in connection with them shall be governed by and construed in accordance with the laws of South Africa, without regard to its conflict of law principles.

• Limitation of Liability

To the fullest extent permitted by applicable law, Wheels4Cash shall not be liable for any direct, indirect, incidental, special, or consequential damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

• Your use or inability to use the website.
• Any unauthorized access to or use of our servers and/or any personal information stored therein.
• Any interruption or cessation of transmission to or from the website.
• Any bugs, viruses, trojan horses, or the like that may be transmitted to or through our websites by any third party.
• Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the website.
